Terms & Conditions

These terms set out the basis on which Tiang Law provides pension legal services to clients. Please take a moment to read them before engaging our services. If you have any questions, you are welcome to contact us before proceeding.

1. Definitions

In these Terms and Conditions, the following expressions carry the meanings set out below:

  • "Agreement" — these Terms and Conditions together with any engagement letter or written scope confirmation issued by Tiang Law.
  • "Client" / "You" / "Your" — the individual or entity that engages Tiang Law for services under this Agreement.
  • "Firm" / "We" / "Us" / "Our" — Tiang Law, a legal practice operating in Malaysia.
  • "Services" — the pension-related legal services described in Section 3, as further specified in any engagement documentation.
  • "Content" — all documents, assessments, correspondence, reports, and materials prepared by the Firm in connection with your matter.
  • "Working Day" — Monday to Friday, excluding Malaysian public holidays.

2. Acceptance of Terms

By engaging Tiang Law — whether by submitting an enquiry, signing an engagement letter, or instructing us to act on your behalf — you confirm that you:

  • are at least 18 years of age or are acting on behalf of a person whose interests you are legally authorised to represent;
  • have the capacity to enter into a binding agreement under Malaysian law;
  • have read, understood, and accepted these Terms and Conditions in full.

If you do not agree to any part of these terms, please do not proceed with an engagement. We are happy to discuss any concerns before you commit.

3. Service Description

Tiang Law provides pension-related legal services in Malaysia. Our current service offerings are:

Pension Records Review — RM 280

A careful, confidential review of your pension and retirement-fund records to confirm entitlements and identify any matters that may warrant further attention. Includes a written assessment summary.

Pension Appeal Representation — RM 630

Measured representation in pension entitlement appeals, including evidence assembly, authority correspondence, and plain-language updates for clients with an active appeal.

Comprehensive Pension Stewardship Package — RM 1,090

Full support across a pension matter: records review, appeals, authority correspondence, and continuing advice, with a single point of contact throughout.

Services are available to clients located in Malaysia. The precise scope of any engagement will be confirmed in a written engagement letter prior to commencement of work.

4. Engagement & Scope

  • 4.1 Commencement. An engagement begins once both parties have agreed to the scope of work and the applicable fee, either in writing or in a signed engagement letter.
  • 4.2 Scope Changes. Any material change to the agreed scope must be confirmed in writing before additional work is undertaken. We will inform you of any fee implications at that point.
  • 4.3 Timelines. We will work diligently on your matter, but timelines may be affected by the responsiveness of third parties such as government agencies and retirement fund administrators, which are outside our control.
  • 4.4 Client Identity. In accordance with applicable Malaysian anti-money laundering requirements, we may ask you to provide identity documents before or during the engagement.

5. Client Responsibilities

To allow us to serve you well, you agree to:

  • provide accurate and complete information relevant to your pension matter;
  • promptly supply documents or authorisations we request;
  • inform us promptly of any material change in your circumstances;
  • not provide misleading information to us or to any relevant authority;
  • comply with all applicable Malaysian laws in connection with your matter;
  • maintain respectful communication with our staff and representatives.

We cannot be responsible for outcomes adversely affected by incomplete or inaccurate information you provide.

6. Fees & Payment

  • 6.1 Fees. Fees for each service are set out in Section 3 and in any engagement letter. All amounts are in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated.
  • 6.2 Payment. Payment terms will be specified in your engagement letter. Fees are generally payable before commencement of work unless otherwise agreed.
  • 6.3 Refunds. Where work has not yet commenced, fees paid in advance will be refunded in full upon written request. Once work is underway, any refund will be assessed on a fair, pro-rata basis reflecting the work completed.
  • 6.4 Disbursements. Any out-of-pocket costs incurred on your behalf (for example, official search fees or postage) will be itemised and charged at cost.
  • 6.5 Late Payment. Accounts not settled within the agreed period may result in work being paused until payment is received. We will give reasonable notice before doing so.

7. Confidentiality

We treat all client information with strict confidentiality. Information shared with us in connection with your matter will not be disclosed to third parties except:

  • where you have given us your consent;
  • where disclosure is necessary to carry out your instructions (for example, to relevant government agencies);
  • where required by law, court order, or a regulatory body;
  • where necessary to prevent a crime or protect a person from harm.

8. Intellectual Property

  • 8.1 Firm's Content. All methodologies, templates, precedents, and materials developed by Tiang Law remain the intellectual property of the Firm.
  • 8.2 Client Licence. Documents and reports we prepare specifically for your matter are provided for your personal use in connection with that matter. They may not be reproduced, shared with third parties, or used for commercial purposes without our written consent.
  • 8.3 Website Content. All content on the Tiang Law website is the property of the Firm and may not be copied or reused without permission.

9. Disclaimers

  • 9.1 No Outcome Assurance. Legal matters involve processes and decisions made by third parties beyond our control. We cannot assure any particular outcome on your behalf.
  • 9.2 Information Currency. Pension legislation, regulations, and administrative procedures change. We will advise you on the position as it stands at the time of your engagement, but we are not responsible for changes that occur after advice is given.
  • 9.3 Website Information. General information on our website is provided for background purposes only and does not constitute legal advice. Please contact us for advice specific to your situation.
  • 9.4 Third-Party Services. We are not responsible for the acts, omissions, or decisions of government agencies, retirement fund administrators, or other third parties involved in your matter.

10. Limitation of Liability

  • 10.1 Cap on Liability. Our total liability to you arising from or in connection with any engagement shall not exceed the fees paid by you for that specific engagement.
  • 10.2 Excluded Loss. We are not liable for indirect, consequential, or special losses, including loss of income, loss of opportunity, or reputational damage, even if foreseeable.
  • 10.3 Force Majeure. We are not liable for delays or failures caused by circumstances beyond our reasonable control, including government actions, system outages, or natural events.
  • 10.4 Statutory Rights. Nothing in this section limits rights that cannot be excluded under Malaysian consumer protection law.

11. Indemnification

You agree to indemnify and hold harmless Tiang Law and its personnel against any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your provision of inaccurate or misleading information, or your violation of any applicable law in connection with your matter.

12. Termination

  • 12.1 By You. You may end an engagement at any time by written notice. Fees for work already completed will be due. Where a refund applies, it will be calculated on a fair, pro-rata basis.
  • 12.2 By Us. We may cease acting for you in circumstances where a professional obligation or ethical rule requires it, or where the engagement is no longer viable. We will give you reasonable notice and provide assistance with transferring your matter where appropriate.
  • 12.3 Surviving Provisions. Sections relating to confidentiality, intellectual property, limitation of liability, and dispute resolution continue to apply after any termination.

13. Dispute Resolution

  • 13.1 Governing Law. These Terms are governed by and construed in accordance with the laws of Malaysia.
  • 13.2 Jurisdiction. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Malaysia.
  • 13.3 Informal Resolution. Before commencing formal proceedings, either party shall notify the other in writing and allow 30 days for good-faith discussion aimed at resolving the matter amicably.
  • 13.4 Professional Complaints. Complaints about our professional conduct may also be directed to the relevant Malaysian legal authority in accordance with applicable professional rules.

14. General Provisions

  • 14.1 Entire Agreement. These Terms, together with any engagement letter, constitute the entire agreement between us in respect of the services and supersede all prior discussions or representations.
  • 14.2 Severability. If any provision is found to be unenforceable, the remaining provisions continue in full force.
  • 14.3 Waiver. Our failure to enforce any provision on a particular occasion does not constitute a waiver of our right to enforce it in the future.
  • 14.4 Assignment. You may not assign your rights or obligations under this Agreement without our prior written consent.
  • 14.5 Notices. Formal notices under this Agreement should be sent to the address or email below. Notices sent by email are effective upon acknowledgement of receipt.

15. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or professional requirements. When we do:

  • the revised Terms will be posted on this page with an updated "Last Updated" date;
  • for active engagements, we will notify you of any material changes by email;
  • continuing to use our services after changes take effect constitutes acceptance of the revised Terms.
